Building Owners Insurance in NYC

If you own a brownstone, a walk-up, a mixed-use building with retail below, or a small portfolio across the boroughs, your exposure looks nothing like a standard commercial account. The sidewalk out front is your legal responsibility. Your boiler is older than your tenants. And a single slip-and-fall in New York can outrun a $1 million liability limit without much effort.

What NYC actually holds you responsible for

The sidewalk in front of your building. Under NYC Administrative Code Section 7-210, the owner maintains it, not the city. Broken flags, ice, tree-root heave. If someone goes down, the claim is yours. This is the most common serious liability loss we see on NYC buildings. More on sidewalk liability.

Rebuilding to current code, not to what burned. A fire that damages part of a pre-war building can trigger a requirement to bring the whole structure up to today's code. Standard property coverage pays to restore what was lost. Ordinance or law coverage pays the difference, and it is routinely under-purchased.

Facade work under Local Law 11. Inspection cycles drive scaffolding, contractors, and sidewalk sheds, each of which changes your liability picture while the work is underway. Local Law 11 and how brokers handle it.

Anyone who works in the building. A super, a porter, a part-time handyman. New York requires workers compensation for essentially all employees, and the Workers Compensation Board enforces it aggressively.

Mechanical breakdown. Boilers, elevators, electrical panels, HVAC. Equipment breakdown coverage is separate from your property policy and matters more the older the building is.

What a complete building program includes

  • Commercial property, including loss of rents and ordinance or law
  • Commercial general liability, with sidewalk exposure properly rated
  • Umbrella or excess liability, typically $1M to $5M over primary
  • Equipment breakdown for boilers, elevators and building systems
  • Workers compensation for building staff
  • Builders risk during renovations or conversions
  • Flood, if you're in a FEMA zone or increasingly even if you aren't
  • Directors and officers, if there's a co-op or condo board

Common questions

I bought the building last month. When do I need coverage in place?

Before closing. Your lender will require evidence of property coverage naming them as mortgagee, and most want it several days ahead of the closing date.

My property manager says I'm covered under their policy. Am I?

No. Their policy protects them. You need your own building policy with your own limits. This is one of the most common and most expensive misunderstandings we correct.

I own four buildings through separate LLCs. One policy or four?

Usually one master program scheduling all four, which is cheaper than four standalone policies and avoids gaps between them. It depends on ownership structure and lender requirements.

My carrier sent an inspection report with a list of items. What now?
